3. User Accounts

3.1 Registration

To access certain features of the Service, you must register for an account. You agree to:

3.2 Account Termination

4. Subscription and Payment

4.1 Free and Premium Plans

OpenQuiz offers both free and premium subscription plans:

• Free Forever: Core learning features including unlimited spaced repetition, dictation practice, and manual flashcard creation
• Premium Monthly: $7.98/month with unlimited AI features
• Premium Annual: $52.98/year with all Premium Monthly features

4.2 Billing

Premium subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for the applicable fees.

4.3 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds will be provided for partial periods, except as outlined in our Refund Policy.

5. User Content

5.1 Ownership

You retain all rights to the content you create, upload, or share on OpenQuiz, including flashcards, study sets, and learning paths.

5.2 License to OpenQuiz

By uploading content, you grant OpenQuiz a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the Service.

5.3 Prohibited Content

You agree not to upload or share content that:

• Violates any intellectual property rights
• Is harmful, threatening, abusive, or defamatory
• Contains malware or viruses
• Violates any applicable laws or regulations

6. Intellectual Property

All content, features, and functionality of OpenQuiz, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of OpenQuiz and protected by international copyright, trademark, and other intellectual property laws.

7. AI-Generated Content

OpenQuiz uses artificial intelligence to generate flashcards, learning paths, and other educational content. While we strive for accuracy:

• AI-generated content may contain errors or inaccuracies
• Users should verify important information from authoritative sources
• OpenQuiz is not liable for decisions made based on AI-generated content

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. OpenQuiz disclaims all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy, reliability, or completeness of content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OpenQuiz SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Business interruption
• Costs of procurement of substitute services

Our total liability shall not exceed the amount you paid to OpenQuiz in the 12 months preceding the claim.
